These Terms & Conditions govern the use of the website https://gazeteazulejos.com (“the Site”) operated by Gazete Azulejos Lda. By accessing or using this Site and/or placing an order, you agree to be bound by these terms. Please read them carefully before using our services.

1. COMPANY INFORMATION

2. HANDMADE PRODUCTS

All our tiles are handmade and may show slight variations in color, design, size, or texture. These are inherent to the artisanal process and are not considered defects. By purchasing from us, you acknowledge and accept these characteristics.

3. CUSTOM AND MADE-TO-ORDER ITEMS

Orders involving custom artwork, names, dates, or any made-to-order product cannot be cancelled or refunded once production has started. By confirming the order, the client accepts full responsibility for the specifications provided.

4. PRICING & VALIDITY

All quotes are valid for 15 days from the date of issue, unless stated otherwise. Prices are listed in Euros and may be updated without prior notice. Export orders are exempt from VAT under Article 14 of the Portuguese VAT Code (Código do IVA – Decreto-Lei n.º 394-B/84, de 26 de dezembro), but local duties may apply.

5. DELIVERY & LEAD TIMES

Estimated delivery times are provided for reference only. While we do our best to meet deadlines, Gazete Azulejos is not responsible for delays caused by third parties, customs procedures, weather conditions, or force majeure events.

6. INTERNATIONAL SHIPPING TERMS (DAP INCOTERMS)

All international shipments are made under DAP (Delivered At Place) Incoterms. This means Gazete Azulejos covers the cost of production, packaging, insurance, and shipping to the destination country. The recipient is solely responsible for any local import duties, VAT, or customs clearance fees.

7. CLAIMS AND DAMAGES

All claims for damaged or missing items must be made within 5 calendar days of delivery and include clear photographic evidence of the external packaging and affected products. Claims received after this period may not be accepted.

8. RETURNS & REFUNDS

Due to the nature of our products, we only accept returns for defective items as defined in section 2. Custom or made-to-order items are non-refundable. For approved returns, the customer is responsible for return shipping costs unless otherwise agreed.
Our return and refund policy complies with applicable Portuguese consumer protection laws, including Law no. 24/96 of July 31st (Lei da Defesa do Consumidor).

9. INTELLECTUAL PROPERTY

All content on this website, including but not limited to text, images, logos, and tile designs, is the intellectual property of Gazete Azulejos and may not be copied, reproduced, or used without written permission.

10. LIMITATION OF LIABILITY

Gazete Azulejos is not liable for any indirect, incidental, or consequential damages arising from the use of this website or the products sold. Our total liability is limited to the amount paid by the customer for the specific order.

11. GOVERNING LAW

These Terms & Conditions are governed by Portuguese law, in particular:

  • Código Civil Português
  • Lei n.º 24/96, de 31 de julho (Lei da Defesa do Consumidor)
  • Decreto-Lei n.º 7/2004, de 7 de janeiro (Comércio eletrónico)
  • Regulamento (UE) 2016/679 do Parlamento Europeu e do Conselho, de 27 de abril de 2016 (Regulamento Geral sobre a Proteção de Dados – RGPD / GDPR)
    Any dispute shall be submitted to the competent courts of Porto, Portugal.

12. MODIFICATIONS TO THESE TERMS

Gazete Azulejos reserves the right to update or modify these Terms & Conditions at any time without prior notice. It is the user’s responsibility to check this page periodically. Continued use of the Site constitutes acceptance of any changes made.

13. SAMPLES

Please keep in mind sample tiles may vary in color from future orders due to the handmade process. Each tile is priced per unit, and shipping costs will be added accordingly.
